US or South Korea – Who Gets The Terraform Founder?

According to reports , the Podgorica High Court in Montenegro has approved the extradition of Do Kwon, a prominent figure in the Terra Luna crash. The court fulfilled its part of the task and handed over the case to the Minister of Justice for final decision.

Kwon’s extradition has lingered following competition from the United States and Korea to have him repatriated to their jurisdictions to face prosecution. In an earlier development, the local Supreme Court invalidated the extradition request, forcing the court to restart the process.

With the latest decision by the court, the chances of Kwon’s extradition to the U.S. have increased. That is because the Attorney General who would determine the case has previously clarified his stance, supporting the idea of extraditing Kwon to the U.S.

In deciding Kwon’s fate, the Podgorica High Court in Montenegro noted that the authorities had met the legal requirements to enable them to extradite Kwon to the U.S. According to local reports, Marija Rakovic, head of public relations at the Podgorica High Court in Montenegro, said the Justice Minister, Andrej Milovic, will make the final decision on Kwon’s extradition case. 

It is essential to note that last November, the court decided on the same matter, approving the extradition of Kwon. However, the court reviewed the decision following an appeal that led to the invalidation of the decision by the Supreme Court.

Following a request from the Supreme Prosecutor’s office to determine the legality of the ruling, the High Court reviewed the case again. On review, the Supreme Court established that the court’s authority was only to determine whether the authorities met the legal requirements for Kwon’s extradition. Hence, the final extradition decision lies in the hands of the Minister of Justice.
